Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Profluence application, websites, and related services (the "Service") operated by Profluence, LLC ("Profluence", "we", "us"). By accessing or using the Service you agree to these Terms and to our Privacy Policy.

1. Eligibility and accounts

You must be at least 13 years old (or the minimum age in your jurisdiction) and able to form a binding contract. You are responsible for safeguarding your credentials and for activity under your account.

2. Acceptable use

You agree not to:

• Use the Service to violate any law, third-party rights, or platform terms (including the YouTube Terms of Service, the Meta Platform Terms, the TikTok Developer Terms, the LinkedIn API Terms, and the X Developer Agreement).
• Reverse engineer, scrape, or abuse the Service or its APIs beyond documented limits.
• Upload malicious code or attempt to compromise the security of the Service.
• Resell, sublicense, or expose the Service's intelligence output as your own product.

3. Connected accounts and third-party services

The Service integrates with third-party platforms — including YouTube, Facebook Pages, Instagram Business/Creator accounts, TikTok, LinkedIn, and X — through their official APIs. Your use of those platforms is governed by their own terms, including the YouTube Terms of Service, the Meta Platform Terms, the Google Privacy Policy, and the Meta Privacy Policy. You authorize Profluence to access data from connected accounts as described in the Privacy Policy and, for Meta-specific handling, in our Meta Platform Data Usage disclosure. You may revoke that access at any time from the Accounts page or from the respective platform's app settings.

4. Subscriptions, billing, and refunds

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by the Paddle Checkout Buyer Terms.

Paid plans are billed in advance on a recurring basis. You may cancel at any time from your account or by visiting paddle.net; cancellation takes effect at the end of the current billing period. Refund requests are handled per our Refund Policy. We may change pricing on prospective renewals with notice.

5. Intellectual property

Profluence and its licensors own all rights in the Service, including the underlying intelligence methodology, scoring models, signal-processing systems, and user interface. You retain rights to data you submit and grant Profluence a limited license to process it solely to operate the Service.

6. No warranty

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Profluence does not warrant that intelligence outputs are accurate, complete, or suitable for any specific decision.

7. Limitation of liability

To the maximum extent permitted by law, Profluence will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Profluence's aggregate liability for any claim arising from the Service will not exceed the amounts you paid to Profluence in the twelve months preceding the claim.

8. Termination

We may suspend or terminate access for breach of these Terms or to protect the Service. You may stop using the Service at any time. Sections that by their nature should survive termination will survive.

9. Changes

We may update these Terms. Material changes will be communicated through the Service or by email. Continued use after the effective date constitutes acceptance.

10. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Exclusive jurisdiction lies in the state and federal courts located in Delaware, except where prohibited by applicable law.
